The learned counsel for the Appellant, on instructions from Mr. Sourin Saha, Administrative officer of New India Assurance Co. Ltd., seeks leave to withdraw the Appeal.

The Appeal is disposed of, as withdrawn, with no order as to costs.

The Appellant shall be entitled to refund of Court Fees, as per Rules. The statutory deposit alongwith interest, if any, shall be made over to the Tribunal which shall pass appropriate orders for disbursement of the same.
