By an Order dated 21/8/2017 the applicants were granted interim relief.

Heard the learned counsel for the applicants and the leaned APP. Perused the record of investigation. 3.
At the out set, after hearing the learned counsel for the applicants at length when this Court was not inclined to grant any relief in favour of the applicant Shri. Jagdish T. Singh, the learned counsel on instructions seeks leave to withdraw the application qua Shri. Jagdish T. Singh with liberty to surrender before the concerned Investigating Page-1/3
Officer on or before 11.00 a.m. of 8.8.2018. Leave and liberty granted.

The application for pre-arrest bail of Applicant No.1 Shri. Jagdish T. Singh is dismissed with the aforesaid liberty.

As far as applicant Nos. 2 and 3 are concerned, the applicant No.2 is the mother-in-law and applicant No.3 is sister-in-law of the informant. Perusal of the first information report would indicate that, general allegations are made against them in it. The statements recorded by the Investigating officer till today also indicate that, the allegations qua them are general in nature.

In view of the ratio laid down in the case of Arnesh Kumar vs. State of Bihar and anr. reported in (2014) 8 SCC 273 the applicant Nos. 2 and 3 are entitled to be protected by pre-arrest bail.

In view thereof the interim relief granted by Order dated 21.8.2017 qua the applicant Nos. 2 and 3 is hereby confirmed.
