Heard learned Counsel for the parties.
The learned Counsel for the petitioner submits that they preferred Revision Application before Respondent No.5, Hon'ble Minister for Cooperative, State of Maharashtra, Mantralaya, Mumbai challenging the judgment and order passed by the Divisional Joint Registrar, Co.op. Societies, Kolhapur dated 31.05.2016 in Appeal No. 23 of 2015. They also preferred application for stay. He submits that Appeal as well as Civil Application for stay is pending for hearing on its own merits. The learned AGP, submits that she received instructions from Co.Operative Department, Mantralaya Mumbai by letter dated 26.08.2016 that Revision Application filed by the Petitioner is kept for hearing on 07.09.2016 at 3.00 p.m. and that will Sneha Chavan 1/2

Considering the fact that the Revision is already kept on 07.09.2016, the following order is passed:
a) Petitioner to remain present before Respondent No.5 on 07.09.2016 at 3.00 p.m. For hearing and final disposal of Revision Application. b) Till the decision of the Revision Application pending before Respondent No.5 and providing copy of the order, Respondent No.2 is directed not to proceed the inquiry under Section 88 of Maharashtra Co.op. Societies Act.
c) It is made clear that it is not necessary for the Respondent to give notice to the Petitioner about the hearing before the Respondent No.5. c) Writ Petition stands disposed of accordingly.
