After having heard learned counsel for the petitioner for some time, I am not inclined to interfere with the impugned order which is Award (Part-I). It is held that though the enquiry conducted against the second party is legal, fair and proper and in accordance with the principles of natural justice, however, findings are not proper but are perverse. This order can always be challenged by the petitioner in appropriate proceedings after the reference is finally adjudicated as held by the Hon'ble Supreme Court in the case of Karnataka State Road Transport Corporation Vs. Lakshmidevamma (Smt.) & Anr. reported in 2001 II CLR 640.

Keeping all contentions open to be agitated at a later stage the present Writ Petition is dismissed.
