1) At the out set, the learned APP submitted that the investigation pertaining to CR No. 364/2016 dted 7/7/2016 registered with Santacruz Police Station, Mumbai is completed and the investigating agency will file the charge-sheet within two days from today. 2) The learned counsel for the applicants submitted that the application preferred by the applicants for bail has been dismissed by the learned Additional Sessions Judge, prior to filing of the charge-sheet. That in view of the statement made by the learned APP, he seeks leave to withdraw the application with liberty to file a fresh application for bail before the Trial Court after filing of the charge-sheet or the stage under section 167 (2) of Cr.P.C is reached.

Leave and liberty granted.
