Versus

The State of Maharashtra ..

Respondent ...................

 None present for the Petitioners  Mrs. Auna S. Pai, APP for the State ...................

CORAM : B.P. DHARMADHIKARI & N.R. BORKAR, JJ.

DATE : JANUARY 7, 2020.

P.C.:

1.

Grievance made by about 89 prisoners is relating to their non-production on scheduled dates before the Trial Court.

2.

Learned APP points out that this grievance has been forwarded by the Superintendent of Kalyan District Prison with forwarding letter dated 22.8.2014 which mentions that for want of escort, the situation arose.

5. cri wp 3349-14.doc 3.

Details of demand for escort and percentage of fulfillment thereof has also given in this letter. It appears that in six months from February 2014 to July 2014, the fulfillment percentage is between 23% to 32%. 4.

In this situation, as grievance is made by several prisoners and is pending for last about five years, we direct respondent to take necessary steps to avoid such contingency in future and for that purpose to make necessary arrangements.

5.

With this direction, we dispose of the petition. [ N.R. BORKAR, J. ] [ B.P. DHARMADHIKARI, J. ] Digitally signed by Ravindra M.
