The order dated 12-4-2013 passed by the Learned Joint Civil Judge Junior Division, Baramati, rejecting the application Exhibit 44 filed for correcting the affidavit of examination in chief, is taken exception to by way of the above Petition. The Trial Court has rejected the said application on the ground that the provisions of Order VI Rule 17 of the Civil Procedure Code do not apply to an application filed for amendment of the affidavit in evidence. In my view, having regard to the said reason, no fault can be found with the impugned order. The Writ Petition is accordingly dismissed. [R.M.SAVANT, J] mmj
