This is an application for suspension of sentence and releasing the applicant/accused on bail during pendency of the appeal filed by him.

Heard both sides.

Undisputedly, during pendency of the trial, the applicant/accused was on bail and he has not misused his liberty. Gaikwad RD 1/2

(6)APPANo.12742018 After trial, the applicant is already released on bail by suspending the sentence as the substantive sentence of imprisonment is only for three months for the offences punishable under Sections 138 and 135 of the Electricity Act. It is reported that the applicant/accused has already deposited the fine amount. Hence, the Order :

ORDER

(i) The application is allowed.

(ii) The substantive sentence of imprisonment imposed on the applicant/accused is suspended and he is directed to be released on bail on furnishing P.R.Bond of Rs.15,000/- and on furnishing surety in the like amount.

(iii) As a condition of this Order, the applicant/accused should not repeat commission of similar offence in future.
