This is an application for suspension of sentence and for releasing the applicant / accused on bail during the pendency of the appeal. The applicant had filed similar application vide Criminal Application No.682 of 2015 and the same was rejected by this court on 10th August 2015 by holding that the offence is of serious nature. Therefore, this second application, without there being any change in circumstances, cannot be entertained. avk 1/2

The learned counsel for the applicant / accused submits that applicant is behind the bars and he was on bail during pendency of the trial. The learned counsel, therefore, prays for early hearing of the appeal.

The request seems to be reasonable, as the appeal is of the year 2015.

Hence, the appeal be put up for final hearing in the week commencing from 13th December 2016.
