Issue notice to the respondent. The learned Additional Public Prosecutor waives notice on behalf of the respondent no.1/State. Learned counsel Mr.Gaurang Jhaveri waives notice on behalf of respondent nos.2A and 2B. This is an application for condonation of delay for 8 years and 250 days caused in preferring this revision. Perused the same where-from it reveals that present revision is filed against judgment dated 14th September 2007 passed by the learned Sessions Court in Criminal Appeal No.206 of 2006.
Tilak 2/2 (908)APPR-493-16 According to the learned counsel for the applicant, as there was talks of settlement going on between the parties, and in the mean time, as original accused expired, his legal heirs were further involved for the purpose of settlement, no revision could be preferred earlier, and as such, is delayed as aforesaid. Learned counsel for respondents have no objection for condonation of delay, as according to them, the issue is amicably settled between the petitioner-original accused and respondent nos.2A and 2B - legal heirs of deceased respondent no.2. In the circumstances, and since not objected by respondents, application is allowed.
