The applicant is seeking anticipatory bail in connection with C.R. No.156/2019 registered under section 379 r/w. 34 of IPC and under section 9 and 15 of the Environment Protection Act, 1986 at Vaduj Police Station, Satara. 2.

The FIR is lodged on 13/6/2019, in the midnight, in respect to raid conducted at around 4.00 p.m. on 12/6/2019. The FIR mentions that when the raid was conducted, some accused ran away from the spot. The applicant was one of the persons who ran away from place of incident.

Learned counsel for the applicant submitted that, he was not present at the scene of ofence on the date of incident. Infact, he was attending the function at Yashvantrav Chavan Pratishthan, Mumbai. The applicant was granted interim protection by order dated 29th July, 2019. It is submitted that the applicant has attended Investigating Ofcer as directed by this Court. The said fact that he was in Mumbai is ascertained by the Police. The statement of the witnesses were recorded and they formed part of charge-sheet fled against the arrested accused. 4.

In view of aforesaid facts, interim protection passed by this Court, can be confrmed.

Hence, I pass the following order:

ORDER

(i) Anticipatory Bail Application No. 1662 of 2019, is allowed;

(ii) In the event of arrest of applicant in connection with C.R. No. 156/2019, registered with Vaduj Police Station, Satara, he shall be released on Bail on furnishing P.R. Bond in the sum of Rs.25,000/-, with

(iii) The applicant shall attend the Investigating Ofcer as and when called for till the flling of chargesheet. (iv) Anticipatory Bail Application stands disposed of accordingly.
