This is an application for suspension of sentence and for grant of bail.

It appears that applicant came to be convicted under section 138 of the Negotiable Instruments Act, and is sentenced to suffer RI for six months and to pay fine of Rs.2,75,000/-. Appeal preferred against same judgment and order came to be dismissed by the learned Adhoc Addl. Sessions Judge, Nasik. Learned counsel for the original complainant as well as accused had made a statement that parties have reached amicable settlement in the accompanying revision and state that

Tilak 2/2 (908)APPR-494-16 on the next date, terms of settlement will be filed on record, contending that applicant since is in custody, his signature could not be obtained on the settlement terms.

Legal heirs of original complainant respondent no.2 i.e. Respondent nos.2A and 2B are present in the Court and states to have agreed for settlement terms.

Considering the fact that matter is settled, of which settlement terms will be placed on record, as aforesaid, application is liable to be allowed by suspending substantive sentence imposed upon the applicant as per order below.

O R D E R

Applicant shall be released on bail on his furnishing P.R. Bond in the sum of Rs.15,000/- with one surety in like amount.
