Mr. C.K. Tripathi, learned Counsel for the petitioner seeks leave to delete respondent nos. 1, 2 and 3 from the array of respondents. Leave is granted. Necessary amendment to be carried out forthwith.

Further, Mr. Tripathi also seeks leave to implead Manju Ashok Singh as petitioner no.2. Leave is granted. Amendment to be carried out forthwith.

Leave is granted to file Vakalatnama in respect of newly added petitioners.

The two petitioners and the Respondent no. 4 Sanjay Construction and 1/4

Finance Company Limited (Developer), who are now the only parties to the petition hand in consent terms. The same are taken on record and marked as "X" for purposes of identification.

The parties desire to record that agreement which accompanies the consent terms shall form the part and parcel of the consent terms.

7.

The petitioners, including, the newly added petitioners are present in the Court.

So also Mr. Kamal Khaitan, the representative of Respondent no.4 is present in the Court. The petitioners as well as the representative of Respondent no.4 state that they have signed the consent terms by their own free will and after understanding the scope and import thereof. The parties have been identified by their respective advocates who have also signed upon the consent terms.

The extract of the resolution passed at the meeting of Board of Directors of respondent no.4 authorizing Mr. Kamal Khaitan to sign the consent terms is also produced on record (Copy is produced on record).

The undertakings given by both the parties are accepted as undertaking to this 2/4

Court. There shall be an order in terms of the consent terms.

10.

The Petition is disposed of in the aforesaid terms.

11.

All concerned to act on the basis of authenticated copy of this order.
