For the reasons to be recorded separately, the impugned order dated 21.7.2018 passed by the Additional Commissioner, Pune Division, Pune in No. Appeal/Grampanchayat/Pune-08/2018 is quashed and set aside.

Branch/Dispute Application/SR/21/2017 is restored to its file before Additional Collector, Pune for de-novo consideration. All the contentions on merits are kept open for being agitated before the Additional Collector.

Since parties are litigating for considerable period, the Additional Collector Pune is directed to decide the aforesaid application as expeditiously as possible, however, within a period of 8 weeks from receipt of copy of this Order.
