P.C.:- This is an Application received through jail. Heard Mr. Chaudhari, the learned Advocate appointed through the Legal Aid Committee to espouse the cause of the Applicant and the learned APP. Perused the record. The learned counsel appearing for the Applicant submitted that, the Applicant is behind the bars for last more than 4 years. That, in the Application, the Applicant has stated that, there are approximately 99 witnesses cited by the prosecution in support of its case and as per the Applicant, there is uncertainty of period about the conclusion of trial. He further submitted that, the Applicant has been 1/2

ssm 2 31-ba1931.18.doc falsely implicated in the present crime and therefore, the Applicant may be released on bail.

The learned APP on instructions from the Investigating Officer, who is personally present in the Court, submitted that, as of today the prosecution has already examined 9 witnesses and is further intending to examine approximately 30 more witnesses in support of its case. She further, on instructions, submitted that, it may take about 6 months time to conclude the trial of the present case. In view thereof, the present Application is disposed off with liberty to the Applicant to file a fresh Application for bail before the Trial Court, if the trial arising out of Special Case No. 2 of 2013 pending on the file of the learned Special Judge (under the MCOC Act) does not conclude within a period of 7 months from today. Application is disposed off, with aforesaid liberty. Before parting with the Order, this Court places on record a word of appreciation for the efforts put in by the learned Advocate appointed through the Legal Aid Committee for espousing the cause of the Applicant.
