The Petitioners have sought a writ of mandamus directing the Respondent/Authority to declare the Petitioners as surplus under Rule 26 of the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981 and to absorb the Petitioners. According to the Petitioners there are various decisions which already support the prayer of the Petitioners. The Petitioners have nowhere disclosed that the Petitioners gave application to the Respondent. The Petitioners have directly filed this writ petition without first demanding their right. 2.
