The learned counsel for the petitioner, upon instructions, seeks liberty to withdraw the petition. Liberty as prayed for is granted in the interest of justice with further liberty to approach the Sessions Court under Section 397 of Cr.P.C.

The learned Sessions Court shall decide the Revision Application on its own merits, without being influenced by the withdrawal of this petition. The learned Sessions Judge shall also take into consideration the time spent in pursuing the present Petition. The

Mhi 2 WP-3449-15.sxw petitioners are at liberty to file an application seeking exemption before the learned Magistrate in R.C.C. No.1127/2013. The learned magistrate shall consider it on its own merits since the present petition was scheduled to be heard on 1.9.2015 before this Court and is being withdrawn with liberty to file a revision application.

Petition stands dismissed as withdrawn.
