Learned Counsel for the respondent submits that the Municipal Corporation has now resolved not to act upon the impugned notification dated 4th July 2005 and has further decided to charge fees on the mobile towers considering them to be structures. In that view of the matter, the challenge as raised in the petition is rendered infructuous. The petition is, therefore, dismissed as such. Rule is discharged.
