P. C.:- 1) In pursuance of Order dated 25th September, 2023, Shri. Nishith Mishra, Joint Commissioner of Police, E.O.W. Mumbai has filed a detailed Affidavit dated 17th October, 2023.

2) We have perused the Affidavit. We are satisfied about the steps taken by the investigating agency in attaching the property involved in the present crime. The Affidavit also mentions that, there are 152 investors including the Petitioners who have approached the investigating agency for the claim of investment of their amount of Rs.53,00,40,676/-. 3) It is stated that, by an Order dated 24th June, 2022 passed in Insolvency Petitions, the accused persons and their Companies have been declared as insolvents. That 159 creditors have already approached the Office of the Official Assignee for recovery of their respective claims. 4) Learned APP on instructions from Mr. Vitthal Gole, A.P.I. Unit-1, E.O.W. Mumbai further submitted that, the investigating agency will take further necessary steps for identifying any of the properties, if left from attachment and will submit its report to the Competent Authority accordingly.
