The learned A.P.P. states that an attempt was made on behalf of the Investigating Offcer to serve the notice under Section 41A of Cr.P.C on the applicant, considering the nature of accusations levelled against him in the complaint. A specifc statement is made that the applicant was not available and the notice could not be served.

The learned counsel for the applicant states that he shall receive the notice under Section 41A of Cr.P.C. and shall M.M.Salgaonkar

The Investigating Offcer shall then follow the procedure prescribed under Section 47A and shall record reasons in writing, if he is desirous of effecting the arrest of the applicant. 3.
