The praecipe has been moved seeking withdrawal of the application by reserving the liberty to approach the trial court. The reason reflected in the praecipe for withdrawal is rather startling. It is stated that the High court is busy with urgent matters and therefore he wants to approach the trial court. Though I do not find any merit with reason for withdrawal of the application as the High Court is dealing with the Bail Applications day in and day out, but it is ultimately the choice of the applicant if he wants to approach the trial court, he is at liberty to do so. Permission granted.
