The applicants in ABA/2618/2021 are seeking pre-arrest bail 1/3

2/3 in crime no. 238 of 2020 registered with Mhaswad police station for the offence punishable under sections 302, 143, 147, 148, 149, & 427 of IPC.

The prosecution case against the applicants is deceasedLahuraj was caught red handed by the villagers while stealing cattle at around 2.30 AM. As a sequel, the mob of about 50 to 60 people assaulted him resulting into his death. 4.

The applicants are already charge-sheeted.

The similarly placed other accused persons are already ordered to be released either on regular bail or on pre-arrest bail. This Court, in the aforesaid background particularly having regard to the issue to identity of the accused persons and their role in the commission of crime has granted ad-interim protection. 6.

Learned APP on instructions from the Investigating OfÏcer who is present in the Court informs that the applicants pursuant to ad-interim protection has attended the investigating ofÏcer and co-operated in the investigation.

It is further claimed that the investigation against the applicants is complete and if this Court permits, the charge-sheet can be filed as the applicants' custodial interrogation is no more required.

In the backdrop of aforesaid statement made by the learned APP on instructions, the present applications are disposed of. 9.

The ad-interim protection ordered by this Court stands confirmed.

10.

The applicants shall attend the Investigating OfÏcer as and when directed.

11.

The applicants shall neither tamper with evidence nor influence the witnesses in any way.
