By this petition, the petitioner has challenged the order of issuance of process dated 14th December, 2015 passed by the Additional Chief Metropolitan Magistrate, 38th Court, Ballard Pier, Mumbai in C.C. No.186/SW/2015.

The petitioner has approached this Court without availing the alternative efficacious remedy of filing the revision application before the Sessions Court. Mr. E.A. Sasi, learned counsel for the petitioner, therefore, seeks leave to withdraw the petition with liberty to file revision application with an application for condonation of delay, if
