By this petition, the petitioners have challenged the order of issuance of process dated 30th January, 2015 passed by the Additional Chief Metropolitan Magistrate, 38th Court, Ballard Pier, Mumbai in C.C. No.195/SW/2014.

The petitioners have approached this Court without availing the alternative efficacious remedy of filing the revision application before the Sessions Court. Mr. E.A. Sasi, learned counsel for the petitioners, therefore, seeks leave to withdraw the petition with liberty to file revision application with an application for condonation of delay, if
