This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 808 of 2021 registered at Hinjewadi Police Station, Pune for the offences punishable under Sections 302, 364, 201, 177, 191 r/w. 34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, on the date of alleged incident, Kanchan P Dhuri 1 / 2

924-BA-2710-2022.odt which took place on 20 October 2021, the co-accused Lankesh Rajput assaulted the deceased by knife as he was suspecting that his wife had illicit relations with the deceased. It is alleged that while deceased was in injured condition, he was put in four wheeler and taken to secluded place and there he was burnt. The allegations against the present applicant who appears to be son-in-law of the co-accused Lankesh Rajput are that the present applicant had helped the co-accused Lankesh Rajput to put the deceased in four wheeler and accompanied him to the place where the deceased was burnt.

Prima facie, the case of prosecution against the present applicant appears to be causing disappearance of evidence, i.e., helping the co-accused Lankesh Rajput in disposing of the dead body. Considering this fact, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Arun @ Goliya Kailas Rajput be released on bail in Crime No. 808 of 2021 registered at Hinjewadi Police Station, Pune for the offences punishable under Sections 302, 364, 201, 177, 191 r/ w. 34 of Indian Penal Code, on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount. (iii) The applicant shall attend the concerned police station once in a month i.e. on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of trial.
