Learned counsel for the appellant pointed out that the appeal arises out of a Notice of Motion No.2387/2012 which was filed in a Suit of the year 2012. He states that before the trial court, the issues have already been framed and now the plaintiff has to file his affidavit of evidence, which he will positively file by next date i.e. 17/08/2019 before the trial court.

As the suit is of the year 2012, parties undertake that they 1/2

Mugdha 6-AO 1141-15.doc will cooperate with the trial court for expeditious disposal of the suit and will not seek unnecessary adjournments. The trial court is requested to decide the suit itself expeditiously and preferably within a period of one year from 17/08/2019.
