Heard the Learned Advocates appearing for the parties. By the above Miscellaneous Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicant-wife seeks transfer of Hindu Marriage Petition No.101 of 2010 filed by the Respondent No.1-husband seeking divorce pending before the Civil Judge, Senior Division at Karad to the District Court at Sangli. 2.

Both the parties are educated and since both are of the view that they will be inconvenienced if they are required to travel, the following order is passed, by consent. (i) The Civil Judge, Senior Division at Karad shall conduct the proceedings in Hindu Marriage Petition No.101 of 2010 through video-conferencing. In the event of any difficulty, the Respondents undertakes to provide to the Court a laptop, WIFI and other equipments necessary to conduct the proceedings through video-conferencing.

kpd 2 / 2 924-MCA-254-2016.sxw (ii) The Court of Civil Judge, Senior Division at Karad shall not grant any adjournment to the parties unless absolutely necessary. (iii) The parties too shall not seek any adjournment unless absolutely necessary.

(iv) The Civil Judge, Senior Division at Karad shall endevour to dispose off the Hindu Marriage Petition No.101 of 2010 within a period of six months from the date of this order.

(v) The District Court at Sangli shall render all assistance to the Applicant to use the video-conferencing facility. (vi) Since the proceedings shall be conducted through videoconferencing, the Court at Karad shall fix the hearing of the matter at the time specified in advance.
