Heard the learned Counsel for the parties.

This is an application for pre-arrest bail in connection with C.R.No.31 of 2023 registered with Pusegaon Police Station for the offence punishable under Sections 420 of the Indian Penal Code.

By an order dated 23 August 2023 this Court has granted interim bail. 4.
Learned Counsel for the Applicant, on instructions, submits that in terms of the undertaking given on behalf of the Applicant, the applicant has deposited a sum of Rs.3,49,000/- in this Court.

In view of the aforesaid submission and the fact that the applicant had deposited a sum of Rs.3,49,000/- in this Court and having regard to the nature of the accusation, the custodial interrogation of the applicant does not seem warranted. I am, therefore, inclined to make the order of interim bail absolute. SSP 1/2

Hence, the following order :
ORDER
(i) The Application stands allowed.
(ii) The order of interim bail dated 23 August 2023 is made absolute on the terns and conditions incorporated therein.
(iii) The amount of Rs.3,49,000/- deposited by the applicant be transferred to the Court of Judicial Magistrate, First Class, Vaduj, District Satara, exercising jurisdiction over the Pusegaon Police Station. (iv) The learned Magistrate shall invest the said amount in an interest bearing account and the said amount shall abide the decision of the case arising out of C.R.No.31 of 2023.
(v) The Applicant shall regularly attend the proceedings before the jurisdictional Court.
(vi) The application stand disposed.
(vii) It is, however, clarified that the observations are confined to the consideration of entitlement for pre-arrest bail and the trial Court shall not be influenced by any of the observations in further proceedings.
