Fresh notice to respondent No.4 was issued as per order dated 16/12/2016, which was received with remark that the respondent No.4 refused to accept the notice before the Jailor, Central Prison, Kalamba, Kolhapur. in view of this, notice is deemed to be duly served on respondent No.4. Thus all the respondents are served.

This is an application for condonation of delay of 140 days caused in filing an appeal for enhancement of sentence. In view of the averments made in the application and in the interest of justice, we are of the opinion that delay ought to be condoned. Accordingly, delay is condoned. Application is allowed in above terms.
