After this petition was heard for sometime, learned counsel for the petitioner seeks leave to withdraw this petition with liberty to file appropriate application before the Family Court. Needless to observe that if such an application is filed, all contentions of the respondent in the application are kept open. The learned Judge of the Family Court shall decide the said application on its own merits and without being influenced by the impugned order. The principal interim application (Exhibit 22) shall be decided by the learned Judge of the Family Court on or before 15th October,2017. The parties will co-operate in the final disposal of the interim application Ex.22. All contentions are kept open. (G.S.KULKARNI, J.)
