1) Taking into consideration the gravity of the offence and more particularly the victim Mr. Prakash Jadhav has suffered i.e. 'Fractures' to the skull on the left fronto-parietal cortex, we are not inclined to permit the Respondent No.2, victim to grant consent for quashing of the present crime in-question.

2) In view thereof, learned Advocate for the Petitioners, on instructions, seeks leave to withdraw the Petition with liberty to file an application for discharge before the Trial Court or to contest the said case arising out of CR No. I-147 of 2007 registered with Dindori Police Station, District Nashik.

Leave and liberty granted.
