907-APPP-732-2015-BA-1895-2011.doc This court had directed the applicant to apply for modification of the order after the Charge would be framed against him. This order was passed on 19th April 2012. So far, no Charge has been framed. The learned counsel for the applicant informs that four other accused in this case have filed discharge applications and the said applications are pending. The applicant has been attending Borivali Police Station once in a week right since January 2012. There seems to be no justification for requiring him to continue to attend Borivali Police Station any further.
The condition requiring the applicant to attend Borivali Police Station stands cancelled.
The application is allowed in the aforesaid terms and stands disposed of.
