Heard the learned Counsel for the applicant. The respondents are absent when the matter is called out. This application is preferred by Union of India original opposite party for condonation of 1 year and 94 days delay in filing the first appeal. 2) Considering the submissions made by the learned Counsel for the applicant and the averments made in the civil application, I am satisfied that the applicant has made out the case for allowing the civil application. Hence, following order.
a) Civil Application is allowed in terms of prayer clause (b), which reads thus:
"that this Hon'ble Court be pleased to condone the delay of 1 year 94 days in filing the appeal and dispose of the matter on merits." b) Civil Application is disposed of accordingly. (K.K. TATED, J.)
