The learned counsel for the applicant, at the outset, submits that his application filed under Section 439 of Cr.P.C. before the Sessions Court was dismissed on 8.6.2016 for want of prosecution. The learned counsel submits that the application before the Sessions Court has not been heard on merits. In fact, there is concurrent jurisdiction. However, since the learned counsel for the applicant has withdrawn the application, upon instructions, he may file an application under Section 439 of Cr.P.C. before the Sessions Court, if so advised.

Application stands dismissed as withdrawn.
