Heard rival arguments on the application for condonation of delay filed along with application for leave to file appeal, challenging the acquittal of the respondent No.1 in the matter of offence punishable under Section 138 of NI Act. For the reasons mentioned in paragraph No.3 of the application for condonation of delay the same is granted. The delay is condoned. The application for condonation of delay is accordingly disposed of.

So far as the application for leave along with the appeal is concerned, office to place the matter on 1st July, 2015 after it is numbered. The learned APP for the State and advocate for respondent No.1 waive service. In the meantime, the applicant to serve the respondent No.2's Counsel the copies of the application for leave and appeal memo and other relevant documents.
