DATED : 30th SEPTEMBER, 2022 P.C:- By the present application, the applicant seek withdrawal of the amount of Rs.13,50,000/- along with accrued interest which was deposited by him in this Court pursuant to the order dated 29/3/2006.

The order dated 29/3/2006, record that while considering Application No.984/2006, the applicant expressed his willingness to deposit an amount of Rs.13,50,000/- within a period of six weeks. The said order was confirmed on 18/8/2006. The learned counsel has invited my attention to a judgment delivered by the Metropolitan Magistrate on 31/3/2022 Tilak

2/2 1 IA 3178-22.doc under which the applicant is acquitted for the offence punishable u/s.406, 409, 420 of IPC.

Since the amount deposited by the applicant while conferring protection from arrest, is still lying with this Court, and the applicant was acquitted of the charge for which he was tried, he deserve the amount back.

Application is allowed in terms of prayer clause (a). Registry shall, after due verification of the applicant, be permitted for withdrawal of the amount.
