Before the Trial Court there was a Suit and a counter-claim. The Suit was decreed. The counter-claim was dismissed. Two First Appeals were filed by the counter-claimant in both matters. His Appeal against the decree agaisnt the Suit failed and the common order also disposed of his case in the counter-claim. 2.

The Appeal is, therefore, infructuous and is dismissed. The Civil Application does not survive and is disposed of as infructuous. (G. S. PATEL, J.) 11th July 2017
