The applicant has preferred the present application under Section 438 of the Code of Criminal Procedure seeking transit anticipatory bail for a period of four weeks so as to enable him to approach the competent Court for seeking appropriate reliefs. The applicant is apprehending arrest in C.R. No. 193 of 2017 and 201 of 2017 registered with Pattukottai Police Station, District Tanjavur, Tamilnadu State for the offences under Sections 403, 406, 420 and 120 of the Indian Penal Code.
Learned Counsel for the applicant submits that the applicant is a resident of Sangali, Maharashtra and was a resident of Pattukottai for 18 years. As the informant had approached him, the applicant assured him to provide him with new jewels after melting his old jewellery. Thereafter, he visited his native place and because of an FIR No. 201 of 2017, his properties were vandalized and therefore, he could not return back to Pattukottai leading to the filing of the present FIRs. Because of continuous harassment he even filed a complaint to the Inspector of the Police, Pattukottai vide letter dated 2nd December, 2016. According to learned Counsel, with a view to approach the appropriate Court, the applicant needs interim protection. The offences were registered in the year 2017, however, he came to know recently the registration of crime number in question.
Having regard to the nature of the accusation and the fact that the offence is registered way back in the year 2017, in my considered Rekha Patil 2/3
opinion, without analyzing the merits of the case, the applicant can be granted temporary relief so as to enable him to approach the competent Court. Hence, the following order.
ORDER
(i) In the event of arrest of applicant in connection with C.R. No. 193 of 2017 and C.R. No. 201 of 2017 registered with Pattukottai Police Station, District Tanjavur, Tamilnadu State, the applicant be released on bail on his executing PR bond in the sum of Rs.25,000/-.
(ii) This protection is granted for a period of four weeks from today with a view to enable the applicant to approach appropriate Court in order to seek the appropriate reliefs; (iii) Anticipatory Bail Application No. 2483 of 2021 stands disposed of.
