Mr. Mishra, on instructions of Mr. Ayush Goeal - The Deputy Commissioner of Customs, Nhava Sheva Commissionerate, states that Respondents shall draw sample from container and submit the sample for examination by 06th October 2022. Mr. Mishra states that sample will be drawn in the presence of Petitioner's representative. Mr. Mishra states that time of drawing sample will be intimated to Mr. Aansh Desai, Advocate (Mobile No.9869548220 & Email Id :- aansh19490@gmail.com) latest by 5.00 pm today so that Petitioner's representative may also remain present. Parties are put to notice that punctuality has to be maintained. lgc 1/2

2 (910) wp-10873.22.doc Mr. Mishra states that testing laboratory, viz., Doctors' Analytical Laboratories Pvt. Ltd, Navi Mumbai, will be requested to submit a report within three working days. Copy of the report also to be sent to Petitioner's advocate Mr. Aansh Desai, whose mobile number and e-mail address are given above.

Within four weeks of receiving report, Respondents shall pass final assessment order on the bill of entry which is the subject matter of this Petition after giving personal hearing notice whereof shall be communicated atleast three working days in advance. We make it clear that no application for extension of time on any ground will be accepted and/or entertained. Four weeks provided above is the outer limit and, the concerned officer of Respondents may pass assessment order even earlier.

All rights and contentions are kept open.

Petition disposed. No order as to costs.
