DATED : 6th SEPTEMBER, 2022 P.C:- Considering the nature of allegations levelled against the applicant in C.R.No. 246/2022 registered with Nerul police station, which invoke Sections 420 r/w Section 34 IPC against two accused persons, the applicant being arraigned as accused no.2, the learned APP state that a notice u/s.41-A came to be served upon the applicant.

When the complaint is perused, it can be seen that though the applicant is alleged to have introduced the complainant to the accused no.1 Abhimanyu Aaghav in whose account the amount of Rs.10 lakhs was deposited, it is the Tilak

2/2 3 aba 2377-22.doc applicant who had returned a sum of Rs.3,75,000/-, despite the fact that no amount was received by him.

The applicant is expected to report to the Investigating Officer in pursuance of the notice issued to him and this compliance shall be ensured within a period of 7 days from today.

The Investigating Officer shall follow the procedure prescribed u/s.41A of Cr.P.C and in case, if he is desirous of effecting his arrest, he shall record reasons in writing and give advance notice of 72 hours, including his intention to arrest. Application is disposed off.
