1] This is an application under section 438 of Cr. P.C for pre-arrest bail in CR No.304 of 2018 registered with Kandivali Police Station, Mumbai under sections 143, 144, 147, 148, 149, 150, 307, 506(2) of Indian Pena Code and under section 37(1)(A), 135 of Maharashtra Police Act. 2] This matter was heard at length yesterday in the first session and when this Court was not inclined to grant any relief, the learned Counsel for the applicant had sought time to take instructions, whether the application is to be withdrawn or be heard further on merits. aba.1564-2018.doc learned counsel submitted that the applicant would like to further argue the matter and therefore the matter is kept today for further hearing. 3] Today even on second call, nobody appeared for the applicant. The practice adopted by the counsel for the applicant cannot be countenanced. It appears that the applicant is not interested in persuing the present application.
