The applicant is apprehending his arrest in CR No. 48 of 2019 registered with Amboli Police Station, which invoke sections 324, 326, 143, 144, 147, 148, 149 of IPC. 2.

The Learned APP fairly state that the applicant was granted interim protection in his earlier application being ABA No. 112 of 2020, but the said application came to be dismissed on 25/10/2021 for want of prosecution the interim protection was continued for a period of two weeks.

The learned APP state, that charge-sheet has been filed in the subject CR against the arrested accused and the charges and the role attributed to all the accused persons stand crystallized in form of the charge-sheet. She also state that the accused no.1 and 2 have been released on bail, and the Investigating Officer do not need the custodial interrogation of the applicant, but in order to complete the investigation let the applicant report to the police station on the given date.

: ORDER :

(a) In the event of his arrest, applicant Shames Tabrez Manzoori Khan @ Shamsh Tabrej Mazoor Khan @ Tabrej Mazoor Khan shall be released on temporary bail in connection with C.R.No. 48 of 2019 registered with Amboli police station on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount. (b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence. (c) The applicant shall report to the concerned Police Station on 13/09/2022 and 14/09/2022, between 3:00 pm to 5:00 p.m and thereafter as and when required by the Investigating Officer.
