The above Civil Application has been filed for withdrawal of the amount of Rs.25,000/- with accrued interest if any, the said amount was deposited by the Applicant i.e. the Insurance Company as a condition for filing the Appeal in compliance with Section 173 of the Motor Vehicles Act. The said withdrawal is sought on the ground that the Appeal filed by the Insurance Company has been partly allowed by order dated 14.12.2005 and is therefore disposed of. The Learned Counsel appearing on behalf of the Respondent Nos.1 to 3 i.e. the claimants does not dispute the said position. In view thereof, the Civil Application is allowed in terms of prayer clause (a) and to accordingly stand disposed of. [R.M. SAVANT, J] BGP.
