While permitting withdrawal of earlier application for grant of bail, this Court vide order dated 22/11/2018 granted liberty to approach afresh after charge is framed. I am informed that charge in the matter is already framed on 12/07/2019.
Perused the charge-sheet placed on record. The allegation is, accused committed an offence punishable under Section 376 of the Indian Penal Code on the night of 6th September, 2017 for which F.I.R. Order is modified pursuant to speaking to the minutes order dated 05/12/2019.
2 6.2166.19 ba.doc is lodged on 14th September, 2017 i.e. after delay of about 8 days. But for the statement of the victim, there is no other evidence available on record in the form of medical or documents. Applicant claims to be permanent resident of Mumbai who is married and has two kids and there are no criminal antecedents. That being so, following order:
(i) Applicant be released on bail in Crime No. 248 of 2017 registered with Kherwadi Police Station for offence punishable under Sections 376, 354, 506(II) r/w 34 of Indian Penal Code on furnishing P.R. bond in the sum of Rs. 50,000/- with one or more sureties in the like amount.
(ii) Applicant shall not infuence or tamper with evidence. (iii) Two consecutive absence of the applicant before the learned Sessions Court shall entail the said Court to take out proceedings for cancellation of bail.
Application stands disposed of.
