Mr. Patil, learned counsel for the Applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. The Applicant herein is arrested on 16/1/2016 and is charge-sheeted for the offences punishable under sections 307, 326, 325, 323, 341,143,147, 148, 149, 504, 506 of Indian Penal Code. 2.

By order dated 23/11/2016 this Court had granted bail to the co-accused. The other co-accused are also released on bail by order dated 30/9/2016. At this stage the learned APP submits that the accused who are enlarged on bail for committing the offence punishable under section 302 of the IPC are absconding. They have not yet been arrested. The present applicant is facing charge under sections 307, 326, 325, 323, 341,143,147, 148, 149, 504, 506 of Indian Penal Code. The learned Sessions Court may separate the trial of this applicant/accused if necessary, frame charge, expedite the trial and conclude the recording of evidence as far as possible by 30/9/2018.
