Heard learned counsel and learned APP appearing for the respective parties.

The petition is filed seeking direction to transfer the investigation of MECR No. 07 of 2012 registered with Malad Police Station.

Mr. Yagnik, learned APP, on instructions of the officer concerned, stated that after completion of the investigation into the said MECR, "C"summary report has been filed before the Additional Chief Metropolitan Magistrate, 24th Court, Borivali, Mumbai. In support of his statement, he has placed on record the report dated 29th March, 2017 of Shubhada S Kadam 1/2

17 wp 3457.14.doc the Senior Police Inspector, Malad Police Station, Mumbai. The said report is taken on record and marked "X".

In the above circumstances, the petitioner is at liberty to contest the said "C" summary report by filing a protest petition before the concerned magistrate.
