Heard the learned counsel appearing for the Applicant. The Applicant has been convicted for the offence punishable under Section 302 read with 34 of the Indian Penal Code. The prayer for grant of temporary bail for one month is made on the ground that the Applicant's Aunt died on 23rd August 2016. The Application itself discloses that her husband is alive. Though it is claimed that her husband is not capable of performing religious rites, a medical

ash apl-1076.16 certificate showing disability of the husband is not annexed. The medical certificate of the daughter of the deceased Aunt is annexed to the Application. The learned APP has produced a report submitted by the Investigating Officer. It is pointed out that for one or the other reason, the Applicant continued to enjoy bail from 1st December 2015 to 3rd February 2016 on medical ground.

No case is made out for grant of temporary bail for a period of one month. The Application is rejected.
