Heard learned counsel for the parties.

By this petition, the petitioner seeks a direction to the respondent No.2 - Regional Passport Office at Mumbai, to renew his passport, for a period of 10 years.

Learned counsel for the petitioner states that the matrimonial dispute i.e. C.R. No.28 of 2022, registered with the Versova Police Station, Mumbai, has been amicably settled by and between the parties and that the parties have filed an appropriate writ petition seeking quashing of the said proceeding, which is pending before the 44th Court at Andheri, Mumbai, which arises out of the said C.R. No.28 of 2022. The said C.R. arises out of a matrimonial dispute between the parties.

Considering that the dispute is a matrimonial dispute, we direct the respondent No.2, to renew the petitioner's passport bearing No.L4332058 for 10 years, as per the Passport Act and the Rules, thereunder.

Needless to state, that that if the aforesaid proceeding is not quashed for any reason, the petitioner to obtain the permission of the trial Court before leaving the country.
