The applicant herein is an accused in Sessions Case No.471 of 2006 and is facing charges under Sections 302 and 120B of the Indian Penal Code. Initially, Crime No.298 of 2003 was registered at Shahibaug Police Station at Ahmedabad. That Sessions Case was transferred to Pune. The applicant, who is the principal accused, did not appear before the Sessions Court at Pune.

The learned counsel for the applicant, upon instructions, submits that before the matter was transferred to Pune, the witnesses were examined at Gujarat. For the past 10 years, the applicant had not attended a single date at Pune. Hence, non-bailable warrant was issued and the applicant was

The learned APP rightly submits that on 27.7.2016, the application filed by the present applicant ws heard by Hon'ble Predecessor Bench and an order was passed that the trial be expedited and the recording of evidence can be completed within six months. In these circumstances, the applicant does not deserve enlargement on bail as there is no hope that he wouild face the trial.

The application stands rejected.
