Grievance of the Petitioner is that though FIR bearing CR No.75 of 2016 was registered at his instance by Malbar Hill Police Station as back as on 30th May 2016, so far the investigation is not completed.

Mr. Kapadnis, the learned APP, on instructions, makes a statement that the said FIR is registered on the allegation of commission of the offence punishable under sections 406, 411, 420, 467, 468 and 471 read with 34 of the Indian Penal Code, 1860 and document in question in view of the allegations made in the FIR, is sent to the Director of Hand-writing Expert, Maharashtra State, Mumbai for examination in the month of December 2016. He submitted that the report is still awaited, though 9 reminders have patilsr 1 / 2

been sent to the concerned department. He assures this Court as soon as report from the Director of Hand-writing Expert is received, appropriate report under section 173 of the Code of Criminal Procedure, 1973 would be filed.

In the circumstances, we dispose of this writ petition by requesting the State Examiner of Questioned Documents, Maharashtra State, Mumbai [the Director of Hand-writing Expert] to give its opinion in respect of the disputed document as expeditiously as possible and at any rate within the period of four weeks from the date of receipt of a copy of this order. The Investigating Officer of the said crime shall approach the concerned officer with a copy of this order. 4.

Writ petition stands disposed of.
